2. Booking and Services

2.1 Colombo Travel & Tour Operator provide a wide range of services in the tourism industry like: Tours, Car Rental, Hotel Accommodation etc. Through our website: www.colombotravel.al a direct contract is created between the service provider and the Client. For booking connecting elements like: Hotels, Flights, Ferry or packages created and delivered by third-party providers, Colombo Travel is not liable for the performance, delivery or quality of service provided by third-party suppliers.

2.2 Client Responsibility for Legal and Travel Requirements
The Client should secure all required information at the time of booking. It is obligated to check by their side local laws and regulations, including visa or safety (Vaccination, health insurance). The Client is responsible for contacting the relevant embassies or authorities to obtain accurate and update information on visa, passport, and entry requirements for their destinations.

2.3 Confirmation
After the client has confirmed and has provided all relevant information, the process continues with confirmation. Once payment is received Colombo Travel generates Voucher for the Client in an electronic way or via email or other appropriate means.

3. Data Protection Under Albanian Law / Privacy Policy
Colombo Travel guarantee the protection of personal data in full compliance with the provisions of Law No. 9887, dated 10 March 2008, “On the Protection of Personal Data,” as amended. Colombo Travel implements all technical and organizational measures to safeguard personal data from accidental or unlawful destruction, unauthorized access, or other forms of unlawful processing for its website.

Personal data collected through our website or by email is processed only for legitimate, specific, and explicitly stated purposes, as required by Article 6 of the law, and only with prior consent of the user. This data will not be transferred or communicated to third parties, except when consent is given or when this information is required by the competent authorities according to the law.

4. Payment

4.1 Advance Payment and Payment Amounts:
By signing the Contract, the Client undertakes to pay an advance equal to the amount specified in the price catalog of the Travel Package, or the offer communicated in writing through one of the electronic communication channels or verbally at the Colombo Travel offices. In any case, the advance must be no less than 30% of the total price of the Travel Package, while the remaining 70% (or the remaining portion if otherwise) must be paid at least 31 days before departure, except for cases specified in the offer provided by Colombo Travel in writing or verbally by sales agents.

4.2 Full Payment at the Time of Signing the Contract:
For contracts signed up to 31 days before departure according to the Travel Package, the final total price must be paid in full at the time of signing this contract, in a single payment, except for cases specifically mentioned in the offer.

4.3 Payment Deadlines and Consequences of Non-Payment:
All the payment deadlines mentioned above are mandatory and essential, and the Client explicitly agrees that failure to make payments within the deadlines specified in clauses 4.1 and 4.2 above constitutes a breach of the essential terms of this Contract, leading to its immediate termination, with penalties as specified in clause 6.5 below.

4.4 Payment Methods
Payment for the Travel Package can be made by:

Cash,
Bank transfer,
Credit or debit card, subject to an additional 3.5% fee on the service value,
International money transfer.

4.5 Service Fees
Credit and debit card companies impose processing fees for transactions made using their cards through POS. Consequently, a non-refundable Service Fee ranging from 3.5% to 5% is applied to certain travel bookings, including flights and hotel packages, hotel bookings, dynamic packages, transfers, car rentals, activities, and group bookings. This Service Fee is included in the final price displayed to the Client.

4.6 Customer Responsibility
Customers are responsible for ensuring that payments are completed in accordance with the instructions provided by Colombo Travel. Failure to adhere to these instructions may result in delays, cancellation of bookings, or additional penalties, for which Colombo Travel bears no liability.

5.Changes to the Travel Package and/or Cancellations

5.1 Changes by Colombo Travel:
If Colombo Travel needs to change one or more elements of the Travel Package up to 1 (one) day before departure, it must notify the Client, explaining the type of modification.

5.2 Client's Right to Reject Changes:
If the Client does not accept the proposed modification according to clause 6.1, they have the right to terminate the Contract by notifying Colombo Travel of this decision within 8 (eight) hours from receiving notice of the modification, without any penalty. In this case, the Client is entitled to choose another travel package of equivalent or higher quality without any additional charge or a lower-quality package, with a refund of the price difference. Otherwise, Colombo Travel will refund the amount paid by the Client within 7 (seven) working days from the moment of the waiver or cancellation under this paragraph.

5.3 Approval of Modifications:
If the Client does not communicate their rejection of the modification to Colombo Travel, their approval of the modifications will be considered as accepted and agreed by them.

5.4 Colombo Travel's Right to Cancel the Package:
Colombo Travel has the right to cancel the Travel Package before departure without any penalty due to:
i) Failure to meet the minimum number of registered participants for the Travel Package,
ii) Force majeure.

6. Cancellation by the Client & Penalty

6.1 Client's Right to Cancel:
The Client has the right to cancel/withdraw from the Contract for any reason, with or without penalty, according to the reservation conditions specified in writing or verbally at the time of making the reservation.

6.2 Cancellation after the Deadline:
If the Client cancels/withdraws from the Contract after the deadline specified for the service in this article 6.2, they are obliged to compensate Colombo Travel for costs incurred with partner services, calculated as follows: The cancellation costs are specified in writing or verbally before the reservation is made.

6.3 Cancellation Request Process:
Cancellation requests must be sent by the client in an official form, explicitly in writing, by email, SMS, or verbally at the Colombo Travel offices. Cancellation requests that are not sent in an official form, even if communicated by phone, will not be valid.

6.4 Breach of Contract by the Client:
Furthermore, if the Client breaches any of the basic conditions of the Travel Package, such as:

Failure to show up physically at the scheduled times and/or dates in the Package,
Transferring the Package from the person specified in the reservation to a third party outside the deadlines specified in the terms and conditions of the Package,
Changes in the parameters of the Package (number of overnight stays, number of persons receiving the service, departure date, and change in accommodation structure, hotel, villa, etc.) outside the specified deadlines in the Travel Package, The Client is obliged to pay Colombo Travel penalties depending on the extra costs incurred due to these changes.

6.5 Penalty & Refund Policy
Cancellation by Customer:
     Cancellations made 30+ days before the tour: 100% refund.
     Cancellations made 15-29 days before the tour: 50% refund.
     Cancellations made 14 days or less before the tour: No refund.

Cancellation by Tour Operator:
In case of a tour operator's cancellation, the customer is entitled to a full refund or an alternative tour of equal value.

Refund Processing:
Refunds will be issued to the original payment method within 10 working days.

Force Majeure:
In the case of force majeure, the operator may offer travel credit or reschedule the tour, but a refund is not guaranteed.

7. Transfer of the Travel Package from the Client to a Third Party

7.1 Client's Right to Transfer:
The Client may transfer their rights and obligations under the Travel Package Contract to a third party that meets all the conditions of the Travel Package. In this case:

7.1.1 The Client must notify Colombo Travel in writing at least 24 hours before the scheduled departure date, providing details of the new Client
7.1.2 The new Client must sign this applicable Contract for the Travel Package, taking over the respective rights and obligations under it.
7.1.3 If the conditions 8.1.1 and 8.1.2 above are not met, the transfer cannot be made.

7.2 Responsibilities of the Transferring Client and New Client:
The Client transferring their rights and obligations under this Travel Package Contract, and the person to whom the Travel Package is transferred, are jointly and separately responsible to Colombo Travel for the payment of the Travel Package Price and any additional costs arising from this transfer.

7.3 Colombo Travel’s Right to Refuse Transfer:
Colombo Travel has the right to refuse the transfer according to this article for reasons related to passports, visas, health certificates, hotel arrangements, transportation services, or any reasons that make it impossible for the new Client to use the Travel Package.

7.4 Transfer Rights Subject to Exemptions and Limitations:
The right to transfer according to the above paragraphs is subject to exceptions and limitations provided by regulations, particularly in the area of security, applicable to the specific services that make up the Travel Package.

8. Confidentiality and Protection of Personal Data

8.1 Confidentiality Obligation:
Colombo Travel undertakes to treat the Client's information and data as strictly confidential and to protect this information and data from unauthorized access.

8.2 Usage of Client Data:
Colombo Travel will not use the Client's data for any purposes other than those specified in the Contract. It will not share the Client's data with third parties for purposes unrelated to this Contract.

8.3 Access to Client Data:
Only employees of Colombo Travel who have explicitly committed to confidentiality by signing Individual Confidentiality Declarations and are responsible for protecting the personal data of Colombo Travel Clients in accordance with the Law on Personal Data Protection will have access to the data and information kept by Colombo Travel.

8.4 Data Processing Compliance:
Colombo Travel agrees that any personal data included or collected in connection with this Contract will be processed in accordance with the requirements of Articles 2 and 5 of Law No. 9887, dated 10.03.2008 "On Personal Data Protection", as amended.

8.5 Client Consent for Data Processing:
To fulfill all contractual obligations, the Client gives consent for the use of their personal data by Colombo Travel, which includes their name, surname, phone number, and email address, to be processed exclusively according to the specific criteria of Article 6 of Law No. 9887. The dissemination of personal data to third parties will occur only if these parties are agents or service providers of Colombo Travel and operate in accordance with Colombo Travel's instructions and the applicable legislation on personal data processing.

8.6 Client's Right to Access and Correct Data:
The Client has the right to access their personal data and correct it, in accordance with Article 13 of Law No. 9887.

8.7 Queries Regarding Data Processing:
If the Client has questions regarding the processing of their data, they must address them to Colombo Travel in accordance with Article 12 of Law No. 9887.

8.8 Legal Obligation to Respond:
Colombo Travel has a legal obligation and undertakes to respond within 30 days from the date of receiving the request for the lawful processing of data, whether to carry out or refrain from correction or deletion.

8.9 Data Protection Measures:
Colombo Travel undertakes to apply all rules related to personal data protection and to obtain the clients' authorization to confirm the processing of personal data solely for the purpose specified in this Contract.

8.10 Sensitive Data Processing:
Colombo Travel does not process sensitive data under Article 3 of Law No. 9987.

8.11 Security Measures for Personal Data:
Colombo Travel undertakes to implement special security measures in accordance with Article 27 of Law No. 9987 to protect the Client's personal data from illegal, accidental destruction, unauthorized access, or dissemination. The data processing environment will only be accessible to employees who have signed the confidentiality declaration as mentioned in Article 8.3 above.

8.12 Right to Object to Data Processing:
The Client has the right to object, at any time, to the processing of their data according to letters "d" and "dh" of Article 6 of Law No. 9887, unless otherwise provided by law. The Client has the right, free of charge, to request Colombo Travel not to initiate or, if processing has already begun, to stop processing their personal data for direct marketing purposes, and to be informed prior to the first dissemination of their personal data for such purposes (Article 15 of Law No. 9887).

8.13 Right to Complain:
The Client has the right to lodge a complaint if they believe their rights, freedoms, and legitimate interests regarding their personal data have been violated, by complaining or notifying the Commissioner for Personal Data Protection and requesting their intervention to restore the violated right. In accordance with the Civil Procedure Code, the Client has the right to appeal to the court. If the Client has filed a complaint, Colombo Travel may not change the personal data until the final decision is made (Article 16 of Law No. 9887).

8.14 Right to Compensation:
The Client has the right to seek compensation in case they suffer damages because of the unlawful processing of their personal data, in accordance with the rules specified in the Civil Code (Article 17 of Law No. 9887).

9. Health & Liability Disclaimer
Colombo Travel has a responsibility to provide a safe and secure environment for all participants, as well as to comply with local and international laws and regulations. Also based on Albanian Tourism Law nr 30/2024 “for some changes in Law nr 93/2015, we have Third-Party Liability Insurance Contract, signed with the Insurance Company.

Limitation of Liability

9.1 Colombo Travel and its affiliates, agents, or employees shall not be held liable for any injury, loss, damage, accident, delay, or irregularity that may occur during the provision of services, including but not limited to those arising from:

Acts of God (including but not limited to weather conditions, natural disasters, etc.);
Accidents or incidents involving third parties (such as transportation, accommodation, and activity providers);
Force majeure events such as wars, strikes, civil disturbances, or government restrictions.
Illness, injury, or death caused by factors outside the Company's control (such as existing medical conditions, activities undertaken by the client, or pre-existing health risks).

9.2 Travel Documents
The Client is responsible for ensuring they have the correct and valid travel documents, including passports, visas, medical documentation, and vaccination certificates, if applicable. The Company will not be held liable for any costs, delays, or issues resulting from the Client’s failure to secure the necessary documents.

9.3 Force Majeure
The Company shall not be liable for any delay, cancellation, or change in itinerary due to force majeure events. This includes, but is not limited to, natural disasters, pandemics, civil unrest, political instability, terrorism, or any other unforeseen events beyond the control of the Company.

9.4 Travel Insurance
The Company strongly recommends that the Client purchase adequate travel insurance, including coverage for medical emergencies, cancellations, and lost or damaged belongings. The Company shall not be liable for any costs incurred by the Client due to unforeseen circumstances, such as medical emergencies or trip interruptions, if the Client has not obtained appropriate insurance.

10.Complaints
In the event that the services provided do not meet the Client's expectations, they are required to immediately notify Colombo Travel via email ( info@colombotravel.al) or with their present in our office. In this case, Colombo Travel will take the necessary measures to resolve the issue promptly, within 3 working days, and find best options to fulfill request by the Client.

11.Dispute Resolution and Applicable Legislation
11.1 This Contract shall be governed and interpreted in accordance with the legislation of the Republic of Albania.
11.2 Any dispute arising during the term of this Contract shall first be attempted to be resolved through negotiations between the parties.
11.3 If the matter cannot be resolved amicably, the Court of First Instance in Tirana will have exclusive jurisdiction to resolve the dispute in question.

12. Notifications
Any notification required or authorized by this Contract, which one party must give to the other, must be made in writing and will be considered as given when delivered in person or sent via email to the addresses below or to any other address that the parties may notify each other from time to time.
